PROTECTION OF PERSONAL DATA AT POLSTARTER P.H.U.P. LESZEK UZARCZYK

INFORMATION CONCERNING PROCESSING OF PERSONAL DATA FOR THE CONTRACTING PARTIES (CLIENTS AND SUPPLIERS)

 

In accordance with Art. 13 of the Regulation of the European Parliament and Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR) we inform that:

 

PolStarter P.H.U.P. Leszek Uzarczyk, with its seat in Gdańsk, ul. Elbląska 125 (NIP: 583-100-02-35, REGON 190205223) is Administrator of your personal data, which collects your personal date in relation with carried out activity of sale of the products and services. 

 

The Administrator, on the basis of analysis of the requirements and assessment of the risks, decided not to appoint the Personal Data Inspector.

 

Your personal data will be processed on the basis of Art. 6 section 1 of GDPR in order to:

  • perform the agreement / order,
  • carry out marketing activities, including presentation of sale offer,
  • pursue any claims arising from the agreements concluded,
  • fulfil the obligations of the Administrator pursuant to the generally binding law.

 

Providing of the personal data is voluntary, but necessary to conclude and perform the agreement.

 

The legal basis for processing of your data, on the basis of Art.6 section 1 of GDPR is:

  • necessity of performing of the agreement or undertaking activities upon your demand prior to conclusion of the agreement;
  • for the marketing purposes a voluntary consent for data processing;
  • necessity for the purposes arising from the legally justified interests, executed by the Administrator;
  • necessity of fulfilling of the legal obligation, the Administrator is burdened with.

 

Your personal data will be processed throughout the period of the Agreement, as well as after its completion until limitation of the claims arising from the Agreement or until expiry of the obligation of storing of the personal data, arising from the generally binding provisions of the law, in particular the tax one and the accounting regulations. In the case of processing of the data on the basis of the expressed consent, personal data will be processed until the moment of its withdrawal.

 

Your personal data will not be processed in an automated way in the form of profiling.

 

The recipients of your personal data will be:

  • employees of PolStarter P.H.U.P. Leszek Uzarczyk authorised to process the data upon order of the Administrator;
  • the entities running courier activities;
  • banks/financial institutions in the case of the necessity of carrying out and ensuring settlements;
  • external entities processing data upon order of the Administrator on the basis of entrustment agreements of data processing;
  • supervisory bodies, authorities and other third parties authorised to obtain the data on the basis of the binding legal regulations in the case, when they demand it or when this is necessary for performing of the Administrator’s obligations imposed by the law.

 

Your data will not be transferred to third countries outside the European Economic Area. If it will be needed to transfer, the transfer will be carried out only upon the terms and in the scope allowed by the law.

 

Additionally I inform you that you have the right to:

  • access your personal data
  • demand correction of your personal data that are incorrect and supplement of the incomplete personal data
  • demand removal of your personal data
  • demand limitation of processing of your personal data
  • lodge an objection to processing of your data, due to your special situation, in the cases when we process your data on the basis of our legally justified interest, including for the needs of the direct marketing
  • transfer your personal data
  • file a complaint to the supervisory authority dealing with personal data protection, that is the Chairperson of the Personal Data Protection Office.

 

In the case when processing of the personal data takes place on the basis of a consent of the person for processing of the personal data (Art. 6 section 1 letter a GDPR), you have the right to withdraw the agreement at any time. The withdrawal has no influence on compliance of the processing done on the basis of the consent prior to its withdrawal, with the binding law.

INFORMATION ABOUT PERSONAL DATA PROCESSING OF CANDIDATES FOR WORK

 

In relation with performing of the requirements of the Regulation of the European Parliament and Council (EU) 2016/679 dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR) we inform the candidates for work about the principles of personal data processing in the recruitment process:

 

  • Your personal data Administrator is PolStarter P.H.U.P. Leszek Uzarczyk with its seat in Gdańsk, ul. Elbląska 125 (NIP: 583-100-02-35, REGON 190205223),
  • Your personal data will be processed for the purposes of the current and future recruitments – on the basis of Art. 6 section 1 letter a of the Regulation 2016/679 and the Labour Code of 26 June 1974,
  • Your personal data will be stored during the recruitment, and after its completion they will be immediately deleted or in the case of giving consent for data processing for the needs of further recruitment, they will be stored throughout the period of 2 years,
  • The recipients of your personal data will only be the employees of PolStarter P.H.U.P. Leszek Uzarczyk, the entities authorised to obtain the personal data on the basis of the legal regulations and the entities cooperating in the recruitment process,
  • You have the right to demand from the Administrator an access to the personal data, the right to correct thereof, remove or limit processing, the right to lodge an objection to processing, the right to transfer of the data and the right to withdraw of the consent at any time,
  • You have the right to lodge a complaint to the supervisory body that is the Chairperson of the Data Protection Office,
  • Providing of the personal data is obligatory on the basis of the legal regulations, and in the other scope - voluntary. The obligation of providing by you of the personal data such as: first name (names) and surname, parents’ names, date of birth, place of residence (correspondence address), education, course of the previous employment arises from Art. 221 of the Labour Code and other labour law regulations. If in the recruitment application there are additional personal data included beyond the ones indicated in the legal regulations (for example telephone number, email address, image, hobby, interest, foreign languages skills etc.) then processing of these data takes place on the basis of your consent (Art. 6 section 1 letter a GDPR). Such consent has been given by sending the recruitment application to us via for example portal Pracuj.pl, by electronic mail or traditional mail. In the case when we collect personal data on the basis of the given consent, providing of personal data is voluntary.
  • The persons interested in participating in the recruitment process are requested to give consent for personal data processing by placing in the contents of the application or CV of the following clause: “Pursuant to Art. 6 section 1 letter a of the General Data Protection Regulation of 27 April 2016 (EU Official Journal L 119 of 04.05.2016) I agree for processing of my personal data by PolStarter P.H.U.P. Leszek Uzarczyk with its seat in Gdańsk, ul. Elbląska 125 for the needs of the current and future recruitment.”

INFORMATION CONCERNING VISUAL MONITORING

 

Pursuant to Art. 13 of the Regulation of the European Parliament and Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR) we inform that on the basis of Art. 6 section 1 letter f of GDPR, as well as on the basis of Art. 222 of theLabour Code, on the area of the seat of PolStarter P.H.U.P. Leszek Uzarczyk in Gdańsk, ul. Elbląska 125 there is applied a visual monitoring with the use of recording devices. The visible plates and tags placed directly in the place of collecting of the data (image) inform about the use of the visual monitoring, for example on the entrance door, notice board.

 

Additionally, we would like to inform that:

  • Your personal data Administrator is PolStarter P.H.U.P. Leszek Uzarczyk, with its seat in Gdańsk, ul. Elbląska 125 (NIP: 583-100-02-35, REGON 190205223),
  • Your personal data will be processed in order to ensure safety and order on the area of the facility – the basis of processing is a justified interest of the Administrator (Art. 6 section 1 letter f GDPR). The legally justified interest executed by the Administrator is ensuring safety for the persons staying in the building and on the area managed by the data Administrator, including ensuring safety for the employees and ensuring safety for the Administrator’s property, employees and guests,
  • Your personal data may be transferred to the entities providing services for the Administrator in relation with carrying out of the monitoring and the law enforcement and administrative authorities in accordance with the binding legal regulations,
  • Your personal data will be processed throughout the period of 24 hours of the visit date.The processing period may be each time prolonged by the period of claims limitation, if processing of your personal data will be necessary to determine or pursue the possible claims or defend against such claims by the Administrator.
  • You have the right to access your data and the right to object to processing of the personal data for the purpose stipulated above, due to the reasons related with your special situation. You are also entitled to lodge a complaint to the supervisory body – the Chairperson of the Personal Data Protection Office, if you consider that processing of the personal data is carried out with an infringement of the legal regulations.

 

Consent for processing, giving and processing of the personal data – image is voluntary, on the other hand a lack thereof may be related with a ban on staying at the area of the facility subject to the monitoring.
